Annual Public Notice to Parents 

   The purpose of this annual notice is to describe the special education programs and services that are available, the process by which students are screened, evaluated, and determined to be eligible for special education services, gifted services, or Chapter 15/504 services, and information regarding the confidentiality of student educational records.  It is the responsibility of school districts, charter schools, or the intermediate unit to ensure that all children residing in the Commonwealth of Pennsylvania, who are in need of special education and related services are identified, located and evaluated.  This responsibility is required by the federal law called the Individuals with Disabilities Education Act as amended in 2004 (IDEA 2004). The IDEA 2004 requires each school entity to publish a notice to parents, in newspapers or other media.  To comply with the requirement, this publication is just one way the South Eastern School District provides annual public notice to the community. 

Services – Age 3 Until School Age

  Children age three through the age of admission to first grade are eligible for specialized services if they have developmental delays and, as a result, need special education. A child between three and the age of beginners is considered to have a developmental delay when one of the following exists:  (i) the child’s score on a developmental assessment device, which yields a score in months, indicates that the child is delayed by 25% of the child’s chronological age in one or more developmental areas; (ii) the child is delayed in one or more of the developmental areas, as documented by test performance of 1.5 standard deviations below the mean on standardized tests. Developmental areas include cognitive, communicative, physical, social/emotional, and self-help.

  Screening for preschool children is available on a on-going basis.  Evaluations for preschool-aged students residing in the South Eastern School District are typically conducted at the Shrewsbury Elementary School or the York Learning Center.  Scheduling and questions regarding preschool screening can be directed to 717-624-6491 or toll free 1-888-669-7735 extension 6491.

 Services for School Age Exceptional Students

  It is the responsibility of the South Eastern School District to ensure that, to the maximum extent appropriate, students with disabilities, including those in public or private institutions or other care facilities, are educated with students who are not disabled.  Special classes, separate schooling, or other removal of students with disabilities from the general education environment occurs only when the nature or severity of the disability is such that education in general education classes, even with the use of supplementary aids and services, cannot be achieved satisfactorily.  Special education services are provided according to the educational needs of the child, not necessarily the category of disability.


  Screening is a pre-evaluation/pre-referral process that occurs in regular education. To identify students who may be eligible for special education, various screening activities are conducted on an ongoing basis. These screening activities include: review of group-based data (cumulative records, enrollment records, health records, report cards, ability and achievement test scores); hearing, vision, physical and speech/language screening; and review by child study or multi-tiered system of support team. 


  When screening results suggest that a student may be exceptional, the district seeks parental consent to conduct an evaluation.  An evaluation for special education services is conducted by an evaluation team that includes the parent, teachers, and any other qualified professionals.  The process must be conducted in accordance with specific timelines and must include procedural safeguard procedures. 

  The evaluation process results in a written evaluation report.  This report specifies a student’s eligibility for special education based on the presence of a disability and the need for specially designed instruction.  The evaluation report also makes recommendations for educational programming. 

  Parents who suspect their child may have a disability may request an evaluation at any time through a written request to the building principal.  If a parent makes an oral request for an evaluation, the school district shall provide the parent with a form for the purpose of putting their request into writing.  Pre-referral practices and procedures shall not serve as a barrier to the right of a parent to request an evaluation.

Non-Public School Students

  Parents of non-public school students who suspect their child is exceptional and in need of special education may request an evaluation through a written request to the Director of Special Education.  If through evaluation it is determined that the student meets criteria of having a disability and they are in need of special education services, a free and appropriate education within the public school setting will be offered.


School entities cannot proceed with an evaluation or the initial provision of special education and related services without the informed written consent of the parents.

Individualized Education Plan (IEP) Development

  Following the evaluation report, an IEP must be developed within 30 calendar days for a student who is identified as having a disability and being in need of services.  The IEP team must include the parent(s) of a child with a disability.  Other required members include at least one regular education teacher of the child (if the child is, or may be, participating in the regular education environment), at least one special education teacher, and a representative of the school district.  The IEP team develops a written plan called the IEP.  The IEP shall be based on the results and recommendations in the evaluation report.  The parents of the child have the right to be notified of and to participate in all meetings of their child’s IEP team.  The IEP is revised as often as circumstances warrant, but at least annually.

Notice of Recommended Educational Placement/Prior Written Notice (NOREP/PWN) 

  The South Eastern School District will notify you in writing whenever it proposes to initiate or to change the identification, evaluation, educational program or placement of a student or whenever it refuses to initiate or to change the identification, evaluation, educational program or placement of a student requested by a parent.  

Protected Handicapped Students

  In compliance with the state and federal law (Chapter 15/Section 504), the South Eastern School District will provide to protected handicapped students services or accommodations which are needed to provide equal opportunity to participate in and obtain the benefits of the school program and extracurricular activities, to the maximum extent appropriate for each individual student.  These related aides are provided without discrimination or cost to the student or family.  In order to qualify as a protected handicapped student, the child must be of school age and have a physical or mental impairment which substantially limits one or more major life activities, have a record of such impairment, or be regarded as having such impairment. 

   Services and protections for protected handicapped students are distinct from those applicable to exceptional students enrolled or seeking enrollment in special education programs.  For further information about the evaluation procedures and provisions of services to protected handicapped students, contact the building principals.

Notice of Services for Gifted Students

  While gifted is not included as one of the disabilities categories under the IDEA 2004, the Pennsylvania State Board of Education’s regulations as set forth in Chapter 16, Special Education for Gifted Students, provide that gifted students are considered to be children with exceptionalities and are in need of specially designed instruction. 

Notice of Services for Gifted Students

For students who are potentially gifted students, the South Eastern School District will take the following steps:

1. Conduct the Gifted Multidisciplinary Evaluation

2. Compile a Gifted Written Report

3. Convene a Gifted Individualized Education Program team meeting to determine whether the student is gifted; and, Develop a Gifted Individualized Education Program if the student is a gifted student

  For students who are gifted and eligible for special education it is not necessary for school districts to conduct separate screening and evaluations, develop separate IEPs, or use separate procedural safeguards processes to provide for a student’s needs as both a gifted and eligible student.

Confidentiality of Student Records

  South Eastern School District protects the confidentiality of personally identifiable information regarding exceptional and protected handicapped students in accordance with state and federal law and district’s student records policy.

Student Records

  School records are an important part of a student’s formal educational file in a public school setting.  They are confidential and privileged; so a policy regarding the collection, maintenance and dissemination of records has been adopted by the South Eastern School Board.  As a parent of an exceptional/non-exceptional child, you have rights guaranteed by the Family Educational Rights and Privacy Act, 1974.  This notice outlines your rights.  You have the right to inspect your child’s records within thirty days from the date of an oral or written request.  You may make a written request for copies of your child’s records at a fee.  Requests for review, inspection or duplication should be submitted to the staff person designated as having responsibility for the records.  See the chart below for listing.

   If you believe that any information in the records is inaccurate, misleading, or in violation of privacy, you may request a change in records or have a hearing if the request is refused.

Release of Information

  Your child’s records cannot be released without your written consent except for directory information and incidents specified in the policy.  Directory information can be released without your consent.  This information may consist of name, address, telephone number, date and place of birth, major field of study, honors won and offices held, recognition for achievements, post high school endeavors, recognition of graduating seniors, participation in officially recognized activities and sports, weight and height (for members of athletic teams), dates of attendance, degrees and awards received, and the last educational agency or institution attended by the student.

   If you do not want directory information about your child transferred, you may prevent release by contacting the school district in writing within thirty days from receipt of this notice.  Please address such requests to the Superintendent.

   Your child’s records may be moved to another school or school system in which you plan to enroll your child if you notify the responsible staff person at South Eastern School District, or if the enrolling school system submits written notification of enrollment.

Maintenance of Records

  Records will be maintained on a child until no longer necessary.  Before records are destroyed you will be notified of your rights to receive a copy of materials.  Permanent records will be kept for 100 years beyond the date the student attains the age of 21.  The permanent records may contain such information as the student’s name, birth date, address, enrollment date, class rank, grades, and academic and non-academic awards.  These rights also apply to eligible students.  An eligible student is a student who is eighteen years of age or is attending an institution of post-secondary education, unless the student is dependent upon the parent, as defined in Section 152 of the Internal Revenue Code of 1954.

   The school district will provide a copy of its confidentiality policy upon request.  Should you feel the school district is not providing the rights as guaranteed by the Family Educational Rights and Privacy Act, 1974, you may file a letter with the U.S. Department of Education, 400 Maryland Avenue, SW, Washington, DC 20201.
